1.1 The Promoter of this Promotion is TravelUp Ltd (Company No: 05121675) of 1 Zodiac House, Calleva Park, Aldermaston, RG7 8HN.

1.2 The Prize Partner of this Promotion is Turkish Airlines, Lyric House, 149 Hammersmith Road, London, W14 0QL.

  1. Eligibility

2.1 The Promotion is open to UK (England, Scotland, Wales and Northern Ireland) citizens and/or permanent residency holders. All participants must be at least 18 years-old at the time of entering the promotion. Employees together with their immediate family members (including their spouses, biological, adoptive or step-parents, legal guardians, children, siblings, or grandparents, any legal dependents and household members) of the Promoter, the Prize Partner, their agencies and companies associated with this promotion are not eligible to enter or win this promotion.

2.2 All entries must be made directly by the person entering the Promotion. Using a false name will result in disqualification.

2.3 Internet access is required and Entrants must have an active personal email account.

2.4 Winning a prize is contingent upon fulfilling all requirements set out in these terms and conditions.

2.5 The Promoter reserves the right at their sole discretion to disqualify any individual found to be tampering or facilitating others to tamper with the operation of the Prize, or to be acting in any manner deemed by the Promoter to be in violation of the terms and conditions, or to be acting in any manner deemed by the Administrator or Promoter to be disruptive.

  1. Promotion Period

3.1 The Promotion begins on Tuesday 13 February 2018 at 10AM GMT and ends on Tuesday 27 February 2018 at 11:59:59 PM GMT (the “Promotion Period”). Promoter shall be the official time-keeper for the Promotion, and Promoter’s computer shall be the official time-keeping device.

  1. About the Prize

4.1 One winner will be randomly selected from among all eligible entries for the prize.

4.2 There is one (1) Prize available, and the Prize includes:

 Return flights for two in standard seats with Turkish Airlines to Istanbul  A three-night stay for two people at the Albatros Premier Hotel on a bed and breakfast basis. 

4.3 Travel must be undertaken by the Winner and their Guest by 31st December2018. The following exclusion periods apply: 12 to 23 February 2018 inclusive, 25 March to 15 April, 2018 inclusive, 1 July to 10 September 2018 and from 15 to 31 December 2018. Flight and hotel accommodation is subject to availability. Should there be no availability on the winner’s chosen dates, every reasonable effort will be made to seek a suitable equivalent alternative accommodation.

4.4 The Winner will be notified via Facebook private message within 28 days of the close of the Promotion.  The Winner must call or email the Promoter to claim their Prize within 14 days of the date of the message notifying them that they have won. If the Winner does not claim their Prize within this timescale, the Promoter reserves the right to offer the Prize to a runner up at its sole discretion. The Promoter and Prize Partner are not responsible if the Prize Winner is unable to take the Prize and no alternatives will be offered. The Winner agrees to provide the Promoter with all information reasonably requested in order for it to substantiate the Winner’s identity, age and place of residence.  Failure to respond with the requested information in the timeframe noted above, or failure to meet the eligibility requirements or these terms and conditions may result in forfeit of the Prize. The Promoter and Prize Partner are not responsible if the Prize Winner is unable to take the Prize and no alternatives will be offered.

4.5 Once the Winner has claimed the Prize it is the responsibility of the Winner to contact TravelUp to book the Prize. This will include flight booking information, hotel booking information and flight details. All products and services are subject to availability. Bookings will not be accepted via the TravelUp or Albatros Premier Hotel websites.

4.6 Booking is required by the Winner of this Prize and booking is subject to availability of the hotel and of flights. Upgrades to the hotel portion of the prize are allowed, subject to the winner paying any additional costs. Albatros Premier Hotel reserve the right not to confirm the booking, to propose alternative dates or to relocate guests in another hotel of the group in case of overbooking. The Prize is not transferable and the Winner must travel. Once booking confirmations are issued no date changes are permitted. Any portion of the Prize not used by the Prize Winner is forfeited. No cash or other substitute will be offered or permitted.

4.7 Prize Winners and their companions are permitted one piece of hand baggage. Up to 8kg of hand baggage may be taken free of charge no bigger than 55 x 40 x 23cm.

4.8 The Prize Winner is responsible for expenses and arrangements not specifically included in the Prize (such as but not limited to accommodation and transportation to and from the departing airport) and any meals, drinks, gratuities, spending money and any incidental expenses incurred while on holiday other than those stated as included. Please note: the Hotel stay will be subject to the terms and conditions of the Hotel and will constitute a separate contract between the Prize Winner and the Hotel. 4.9 The Winner and their guest are bound by Turkish Airlines’ Flight terms and conditions and Conditions of Carriage which can be found at https://www.turkishairlines.com/en-us/any-questions/.

4.10 Prize Winner must ensure that they have the correct travel documentation and obtain the relevant Visas and travel health requirements. Prize Winner is responsible for ensuring they have a valid passport with at least six months validity and travel insurance. Such travel documentation is at the sole expense of the Winner.  Failure to be granted a Visa and or have the necessary travel documentation will result in the Prize Winner forfeiting their Prize.

4.11 TravelUp accepts no liability for use of the Prize or any loss or damage which may arise from the Promotion or use of the Prize.  All Prize winners and their companions fully indemnify TravelUp for any and all losses, liability, action, claim, proceeding, judgment, penalty, fine, damages, fee, cost, charge or expense (including, without limitation, legal fees and expenses) brought, claimed or asserted against TravelUp or for which TravelUp may be liable as a result of this Promotion or of taking or using the Prize.

4.12 Compensation under Regulation 261/2004, Montreal Convention and any other applicable law is strictly excluded irrespective of the cause.

4.13 Prize Winner must agree that (unless applicable law requires otherwise) any right that they have under applicable law to amend their prize holiday ends when the booking has been confirmed. If thereafter the Prize Winner cannot participate in the prize for reasons beyond their reasonable control, the Prize Winner must notify TravelUp to cancel and the Promoter may at their absolute discretion give that prize to someone else. The Prize Winner may not otherwise transfer any aspect of the Prize to another person or assign or transfer any other rights or obligations in connection with these terms and conditions.

7.1 Incomprehensible and incomplete entries (as determined by the Promoter) will be deemed invalid. Obscene, provocative or otherwise questionable content will not be considered. The Promoter retains sole discretion as to what constitutes inappropriate content. The decision of the Promoter is final and no correspondence will be entered into over this decision.

7.2 Entrants are solely responsible for the information they provide and views they express on the Promoter’s social media accounts. The Promoter is not responsible for the user-generated content provided and does not endorse any user-generated views expressed on these web sites.

7.3 Entries must not contain anything which is calculated to bring the Promoter, the Prize Partner or its associated companies into disrepute or that in any way violates applicable laws and regulations or network standards.

7.4 The Promoter is entitled to report and remove any user-generated content on the Promoter’s social media accounts immediately and without notice if a user is in breach of these terms and conditions, are instructed to do so by any third party or if the Promoter, in its sole and absolute discretion, is concerned by any content provided. Users are solely responsible for creating backup copies of any content submitted.

7.5 The Promoter accepts no responsibility for any difficulty Entrants may experience in navigating the Promoter’s Facebook page or any other social media channels.

7.6 No responsibility can be accepted for entries which are invalid, incomplete, illegible, lost or delayed in transit, or which fail to be properly submitted.  Proof of sending does not constitute proof of receipt.

7.7 The Promoter reserves the right to request the winner to provide proof of identity, proof of email address or proof of entry validity in order to claim the Prize. Proof of identification, email and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the Prize in whole and no substitute will be offered.

7.8 In the event of a dispute as to the identity of an entrant, the authorised account holder of the email address associated with the Facebook or Email account from which the entry is made will be deemed to be the entrant and he/she must comply with these Terms & Conditions. “Authorised account holder” is the natural person to whom the applicable Internet service provider or other organisation (such as a business or educational institution) has assigned the email address for the domain associated with the e-mail address. A potential Prize Winner may be asked to provide Promoter with proof that the selected Winner is the authorised account holder of the email address associated with the Facebook account.  If a dispute cannot be resolved, the Entry will be deemed ineligible. Promoter’s failure to enforce any term of these Terms & Conditions shall not constitute a waiver of that provision.

7.9 If there is any reason to believe that there has been a breach of these Terms and Conditions, the Promoter may, at its sole discretion refuse to accept an entry. The Promoter will be the final arbiter in any decisions and these will be final and binding and no correspondence will be entered into. The Promoter may at its absolute discretion disqualify any entrant found to be tampering with the entry process or operation or to be acting in any manner disruptive to the promotion.

  1. Additional terms

8.1 If for any reason the Promotion is not capable of running as planned for reasons (including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion), and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or alter the Promotion or these terms and conditions, at any stage, but will always endeavour to minimise the effect to Entrants in order to avoid undue disappointment. If the Promotion is cancelled a notice will be published on the Promoter’s social media pages and/or website.

8.2 The terms and conditions of any other third party supplier will also apply to the prize where applicable. If there is a conflict between third party terms and conditions and these terms and conditions, these shall take precedence.

8.3 The Promoter reserves the right to substitute the Prize for a prize of equivalent or greater monetary value if this is necessary for reasons beyond its control.

8.4 The Promoter will not be liable for any prize(s) that do not reach the winners for reasons beyond the Promoter’s reasonable control.

8.5 The Promoter’s decision is final and binding in all respects on all entrants. No correspondence will be entered into. Entries that do not comply in full with these entry terms and conditions will be disqualified.

8.6 The Prize Winner agrees to the use of their name, written entry and home town/city to be used by the Promoter and its associated companies for post-event publicity purposes (including but not limited to publishing on the TravelUp blog, on the TravelUp website and on the TravelUp Facebook, Twitter and Instagram accounts and in the media), and will co-operate with any other reasonable requests by the Promoter relating to any publicity.

The winners agree to allow the Promoter to use their name and likeness for advertising and publicity purposes without additional remuneration.

8.7 In addition to the use specified above, the Promoter will use each winner’s, and each entrant’s, personal details for the purpose of administering this promotion.

8.8 The Promoter may refuse or disqualify any entry (including winning entries) if the entrant concerned or anyone authorised by the entrant to deal with their entry, acts in a way towards the Promoter or TravelUp staff which the Promoter reasonably considers to be inappropriate, unlawful or offensive. If the winning entry is disqualified the Promoter reserves the right to award the prize to another entrant.

8.9 Entrants will be deemed to have accepted these terms and conditions and agreed to be bound by them when entering this Promotion.

8.10 The Promoter will treat all personal information obtained through each of the Entrants’ registration as private and confidential and will comply with the Data Protection Act 1998. Prize winner contact details will be used to administer the Prize, unless the winner opts-in for additional marketing emails. The Promoter’s commitment to the Entrants’ privacy and the security of their personal information is outlined in the Promoter’s privacy policy available on www.travelup.co.uk/privacy-policy and the Entrant consents to the Promoter using personal data as per the terms of the privacy policy.

8.11 These terms and any issues or disputes which may arise out of or in connection with these rules (whether such disputes or issues are contractual or non-contractual in nature, such as claims in tort, for breach of statute or regulation or otherwise) shall be governed by and construed in accordance with English law.  Entrants hereby irrevocably submit to the exclusive jurisdiction of the English courts to settle any such dispute or issue.
